Acceptance of Terms

By accessing or using GeoLens at geo.thoibatrader.com ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. These terms apply to all users including visitors, registered users, and those who purchase reports.

About the Service

GeoLens is a land risk intelligence platform operated by Thoiba Trader that generates statistical probability reports for any geographic location in India. Reports are produced using publicly available satellite and remote-sensing data from NASA, USGS, ESA, Open-Meteo, and OpenStreetMap.

GeoLens is an information and decision-support tool. It is not a licensed engineering, surveying, legal, or financial service. Reports are generated algorithmically from public satellite archives and are not based on physical site inspections.

Critical Disclaimer — Nature of Reports

⚠️ IMPORTANT: All GeoLens reports are statistical probability assessments derived from satellite and remote-sensing data. They are NOT:

A substitute for a licensed geotechnical or structural engineering report
A legal certificate, government approval, or regulatory compliance document
A guarantee or warranty of site safety, flood-free status, or structural suitability
Admissible as formal documentation for bank loans, RERA registration, or insurance claims
A replacement for field surveys, soil boring tests, or on-site measurements

Satellite data has inherent accuracy limitations (ERA5: ±5% precipitation, SRTM: ±10m elevation). Risk classifications are probabilistic and may not reflect actual conditions at any specific point in time.

Permitted Use

You may use GeoLens reports for the following purposes:

Personal research and due diligence before purchasing land or property
Preliminary site assessment before engaging professional engineering services
Educational and informational reference about climate and seismic risk
Internal decision support for real estate investment, farming, or construction planning
Sharing with your licensed engineers, architects, or legal advisors as background information

Prohibited Use

The following uses are strictly prohibited and constitute a violation of these Terms:

Representing a GeoLens report as a certified engineering or legal document to any government body, bank, court, or regulatory authority
Reselling, redistributing, or sub-licensing GeoLens reports or the underlying data without written permission from Thoiba Trader
Using the reports to make representations to third parties that imply formal certification or government approval
Automated scraping of the service, bulk report generation for commercial resale, or API access beyond permitted usage
Reverse engineering, copying, or replicating the platform's analysis methodology for competitive products
Using the service for any unlawful purpose under Indian law or applicable international regulations

Payment & Delivery Policy

Reports are provided on a one-time fee basis (Basic: ₹299, Standard: ₹799, Premium: ₹1499). Payments are processed via Razorpay at the time of report generation.

Once a report has been successfully generated and downloaded, the service is considered fully delivered — no re-delivery or cash refund will be issued
GeoLens does not issue cash refunds under any circumstances
If payment was deducted but the PDF was not delivered due to a technical failure, we will manually regenerate and deliver your report within 24 hours to 3 business days
Re-delivery requests must be submitted within 7 days of the failed transaction, with an error screenshot, payment deduction proof, and your coordinates and plan details
Dissatisfaction with report results, risk scores, or satellite data values does not constitute grounds for re-delivery

Intellectual Property

The GeoLens platform, its design, analysis methodology, report format, and branding are the intellectual property of Thoiba Trader. The underlying satellite data used in reports is sourced from public domain and open-licensed datasets (NASA, USGS, OpenStreetMap CC-BY-SA, Open-Meteo).

You are granted a non-exclusive, non-transferable licence to use the report you purchase for personal or internal business purposes
You may not reproduce, republish, or commercially distribute report content without written permission
Attribution to GeoLens / Thoiba Trader is required if report content is cited in any published document

Limitation of Liability

To the maximum extent permitted by applicable law:

Thoiba Trader shall not be liable for any financial loss, property damage, construction failure, or personal injury arising from reliance on a GeoLens report
We are not liable for data inaccuracies originating from third-party APIs (NASA, USGS, Open-Meteo, etc.) that are outside our control
Our total liability to you for any claim arising from use of the service shall not exceed the amount paid for the specific report in question
We provide the service "as is" without warranties of accuracy, completeness, fitness for a particular purpose, or uninterrupted availability

Professional Advice Recommendation

Every GeoLens report includes a reminder that all construction and land purchase decisions should involve a licensed civil engineer, structural engineer, and legal professional. GeoLens is designed to inform that consultation, not replace it. Users who proceed with major construction or purchase decisions based solely on a GeoLens report do so at their own risk.

Third-Party Services

GeoLens fetches data from third-party public APIs. We are not responsible for the availability, accuracy, or changes to these external data sources. Temporary unavailability of external APIs (Open-Meteo, USGS, etc.) may result in incomplete reports. In such cases, affected sections will display "Data Unavailable" rather than estimated or fabricated values.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or the use of GeoLens shall be subject to the exclusive jurisdiction of the courts in the state of Assam, India. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full effect.

Changes to These Terms

Thoiba Trader reserves the right to update these Terms of Use at any time. Updates will be reflected in the "Last Updated" date above. Continued use of the service after any changes constitutes your acceptance of the revised terms. We recommend checking this page periodically.
